Session Overview:
Discretionary waiver is a mechanism, whereby in exceptional circumstances,
DfC can exercise its discretion to ‘waive’ recovery of all or part of an overpaid
benefit.
This has become more important following a change in the law which, for the first time,
allowed recovery of some overpaid benefits even in cases when the overpayment was
caused by official error.
participants will be able to:
- Understand what a Discretionary Waiver is and when it can be used.
- Explain the legal and policy background to benefit overpayments, particularly those arising from official error.
- Identify the key factors that support a successful waiver application.
- Prepare and submit effective waiver requests on behalf of clients.
- Gather and present appropriate supporting evidence.
- Advise clients on next steps where a waiver request has been refused.
- Apply current guidance and relevant case law to strengthen representations.
